A new bill filed by State Sen. Terence Everitt in the North Carolina Senate seeks to criminalize riot participation or incitement when linked to attempts to overthrow government, according to the North Carolina State Senate.
The bill, filed as SB 244 on March 5 during the 2025 regular session, was formally listed with the short title: ‘January 6 Riot/Attempt Overthrow of Gov’t.’

In essence, this bill makes it a Class F felony in North Carolina to willfully engage in a riot or incite a riot if, during that riot, an attempt is made to overthrow the government of the United States, the state of North Carolina, or any of its political subdivisions. Specifically, any person actively participating in such a riot, or inciting others to riot when the incitement contributes to an attempted governmental overthrow, will face Class F felony charges. The provisions will take effect on Dec. 1, 2025, and will apply to offenses committed on or after this date.
Of the two sponsors of this bill, Everitt proposed the most bills (seven) during the 2025 regular session.
Bills in North Carolina follow a multi-step process before becoming law. A lawmaker starts by filing a bill, which is assigned to a committee for review. The bill must be read three times in each chamber. If one chamber changes the bill after the other passes it, both must agree on the final version. Once both chambers approve the same bill, it goes to the governor, who has 10 days (or 30 if the legislature is not in session) to sign, veto, or let it become law without a signature.
