A new bill filed by State Sen. Terence Everitt seeks to restore local governments’ ability to control zoning changes without property owners’ consent in parts of North Carolina, according to the North Carolina State Senate.
The bill, filed as SB 212 on Feb. 27 during the 2025 regular session, was formally listed with the short title: ‘Restore Down-Zoning Auth./Granville & Wake.’

In essence, this bill restores the authority of local governments in Granville and Wake Counties, North Carolina, to initiate down-zoning without requiring the written consent of property owners. Down-zoning refers to zoning ordinance changes that either decrease the development density, reduce the permitted land uses, or create nonconformities for non-residential land. The bill allows local governments to down-zone property unilaterally, affecting development and land use regulations. It retroactively applies to December 11, 2024, reverting any ordinances impacted by previous legislation to their state as of that date. The bill becomes effective immediately upon becoming law.
Everitt proposed another four bills during the 2025 regular session.

The bill must be read three times in each chamber. If one chamber changes the bill after the other passes it, both must agree on the final version.
